B-6 The Bradenton Bradenton, Herald Florida Thursday, 33505 June 9, 1977 Florida briefs Man says ex-commissioner offered him $5,000 bribe JACKSONVILLE (AP) Norman C. Faul of Lake City says former Columbia County Commissioner Frank N. Thomas told him that for $5,000 he could get out of a first-degree murder charge with probation. Faul said he rejected the offer, but nevertheless it happened as Thomas said. The testimony was given Wednesday during the federal trial of Thomas, charged with perjury for telling a grand jury he didn't solicit such a bribe.

Faul said he was arrested and charged with first-degree murder Nov. 8, 1971, for the barroom shooting of Carl Dicks. A few days later, Faul said, Thomas came to see him in jail. "Mr. Thomas told me that for $5,000 cash it could be arranged whereby I would be taken up to the judge's chambers, plead guilty to manslaughter, be placed on probation and it all would be over with," Faul testified.

He said he meant to go along and his wife borrowed the money. But he said he changed his mind after talking with his son and rejected Thomas' proposition. Faul testified that he dismissed his lawyer and hired A.K. Black of Lake City. Faul was released on bond, pleaded guilty to manslaughter and was put on 10 years probation in 1972.

He testified he paid Black $5,000 for his legal services. The judge who gave Faul the probationary sentence was Circuit Judge Samuel S. Smith, convicted six weeks ago of possessing and conspiring to distribute 1,600 pounds of marijuana. Smith has been sentenced to three years in federal prison. Thomas, 65, was a witness before the grand jury which investigated the marijuana case along with other reporied crimes in the Lake City-Live Oak area of North Florida.

The prosecutor in Faul's case was Virlyn Willis, who is Thomas' son-in-law. Willis is listed as a potential witness as the Thomas trial continues. Councilmen, police chief resign EDGEWOOD (AP) Two town councilmen and the police chief of this small community near Orlando have resigned as a result of a dispute over a third council member. The resignations of Councilman Anibal Rodriguez, Council President Howard Hatfield and Police Chief Tommy Thompson came after a heated council session Tuesday, Mayor Craig Andrews said Wednesday. Rodriguez submitted a motion to impeach Councilman Clyde King for alleged misuse of powers.

The motion failed on a 2-2 vote, with King not voting. A controversy involving King began in January when Hatfield wrote Gov. Reubin Askew that King has misused city property, interfered with an arrest and tampered with traftic tickets. The governor asked State Atty. Robert Eagan to investigate.

An investigator for Eagan reported that "no criminal, prosecutable wrongdoing was found." Childers declares war on Alabama TALLAHASSEE (AP) State Sen. W.D. Childers has declared war on the state of Alabama because it increased hunting and fishing licemse fees for out-of-state residents. The Alabama legislature recently doubled such fees and Childers told the Florida Senate Wednesday that it should follow suit. "This is war, total war.

I have just declared war on the state of Alabama," said Childers, a key Senate leader. Childers, D-Pensacola, particularly upset because the fees will hit hardest on his North Florida constitutents who often hunt and fish in neighboring Alabama. He said non-resident Alabama hunting licenses were being raised from $25 to $50 while non-resident fishing licenses were going up from $5 to $10. He proposed similar hikes in Florida, which he said would raise $45 million to $65 million in new state revenue from the $17.5 million out-of-state sportsmen who visit Florida each year. Childers said he would propose raising non-resident fishing licenses from $7.50 to $10 and the non-resident hunting licenses from $26.50 to $50.

Man accused of rape arrested DELRAY BEACH (AP) A man accused of raping and pistol-whipping a 72-year-old woman who was recovering from open-heart surgery was arrested Wednesday as he stepped from a bus in Statesboro, Ga. Palm Beach County Sheriff's Lt. Richard Sheets identified the man as Harry Lee Sheffield, 26. Sheets said Sheffield is charged with armed rape, armed robbery, armed burglary and aggravated assault with a gun. Sheriff's detectives said they will go to Statesboro to return Sheffield to Palm Beach County to face the charges.

Earnest was accused of using candy and bubble gum to lure the girls to his office during a church gathering in 1976 and then kissed them and rubbed the private parts of their bodies. As a condition of probation, Earnest must leave Highlands County and seek psychological treatment.

Ex-legislator ordered to fix door PENSACOLA (AP) A former state legislator who pleaded guilty to battery and trespassing has been fined and ordered to fix Maggie Lee Kroll's broken door. R.W. "'Smoky" Peaden, 44, was indicted by the Escambia County grand jury last March. The charges arose from a Feb. 14 incident involving Peaden and Miss Kroll.

He pleaded guilty Wednesday, admitting to breaking a lock on Maggie Lee Kroll's apartment door after their relationship erupted in a dispute. She was hospitalized with a concussion. Escambia County Judge Frank Bell sentenced Peaden to suspended jail terms totaling five months and fined him more than $700. Peaden also was ordered to pay Miss Kroll's medical exenses, repair her door and refrain from confrontations with her.
